What can I recover from a personal injury lawsuit?

On Behalf of | Dec 14, 2020 | Firm News

If you’ve been injured in a car accident, then you’re probably dealing with a lot right now. Your physical pain might be unbearable, and the emotional toll of dealing with it all can be enormous. Making matters worse is the fact that you’re probably facing financial struggles, too, on account of unexpected medical expenses and lost wages. As difficult as it can be to cope with these losses, you might be able to recover compensation for your damages if your accident was caused by another person’s negligence.

What can you recover from a personal injury lawsuit?

Fortunately, a successful personal injury lawsuit can provide you with a lot of relief. Here are some of the damages that you might be able to recover:

  • Lost wages: You should be able to recover any wages you’ve lost since your accident, so long as you can tie those losses to the wreck, but you might also be able to recover any expected lost wages as you continue your recovery. Any lost earnings capacity should be considered, too.
  • Medical expenses: Similarly, incurred medical expenses are recoverable, but so, too, are anticipated medical expenses. Rehabilitation costs and money spent on medication might also be part of the damages you seek and ultimately recover.
  • Non-economic losses: Other damages, like pain and suffering, can also be recovered from a personal injury lawsuit. These losses are difficult to calculate, of course, which means you really have to paint a vivid picture of how your injuries have caused some loss of enjoyment of life.

Coming up with figures for each of these categories can be difficult, which means that there’s a lot of room for argument. Oftentimes the testimony of an expert witness, like a doctor who is familiar with the costs associated with treating your injuries, proves beneficial.

Know how to build your case

Before you get to the point of proving and hopefully recovering damages, you’ll have to successfully impose liability. Both portions of your case can be fraught with complexities, which is why many car accident victims choose to have an attorney on their side who can help them build the legal arguments that are necessary to succeed.
